Gemäss den im Anhang zum Abkommen aufgeführten Kriterien sind im Falle eines begründeten Verdachts auf „ Betrugsdelikte und dergleichen “ folgende Personen durch das US-Amtshilfegesuch erfasst :
Kunden der UBS mit Wohnsitz in den USA, die zwischen 2001 und 2008 mehr als eine Million Franken auf nicht gemeldeten Konten ( undisclosed ( non-W-9 ) custody accounts und banking deposit accounts ) direkt hielten und daran wirtschaftlich berechtigt waren;
US-Staatsangehörige ( ungeachtet ihres Wohnsitzes ), die zwischen 2001 und 2008 an Konten einer Offshore-Gesellschaft ( offshore company accounts ) wirtschaftlich berechtigt waren.

US-domiciled clients of UBS who directly held and beneficially owned undisclosed ( non-W-9 ) custody accounts and banking deposit accounts in excess of CHF 1 million at any point in time between 2001 and 2008;
US persons ( irrespective of their domicile ) who beneficially owned offshore company accounts established or maintained between 2001 and 2008.
