Hat der Kunde durch ein schuldhaftes Verhalten zur Entstehung eines Schadens beigetragen, bestimmt sich nach den Grundsätzen des Mitverschuldens, in welchem Umfang Bank und Kunde den Schaden zu tragen haben.
( 2 ) Für Folgeschäden aus der Verzögerung oder Nichtausführung von Überweisungen ist die Haftung auf höchstens 12.500,00 EURO je Überweisung begrenzt.
Diese Haftungsbeschränkung gilt nicht für Vorsatz oder grobe Fahrlässigkeit sowie für den Zinsschaden und für Gefahren, die die Bank besonders übernommen hat.
