Auch die von der Staatsführung angeordneten Befehlstaten, die Mitwirkung an der Massenvernichtung, legte das Gericht einigen Angeklagten als gemeinschaftlichen Mord zur Last, wenn dem Schwurgericht als zweifelsfrei erwiesen galt, dass der Täter die gemeinsam mit anderen begangenen Mordtaten sich zu eigen gemacht, die befohlene Tat als eigene gewollt hatte.
Als Gehilfen (Beihilfe zum Mord) und mit zeitigem Freiheitsentzug wurde bestraft, wer nach Erkenntnis der Tatrichter allein auf Befehl an den Morden mitgewirkt, wer die angeordneten Tötungen als fremde, mithin nicht als eigene Tat, ausgeführt hatte.
Die sogenannte Gehilfenrechtsprechung der bundesdeutschen Gerichte in zahlreichen NS-Prozessen rief harsche Kritik und entschiedenen Widerspruch hervor.
